It is very important that you are seeing a doctor and taking your medication as prescribed.

In order to win your Social Security Disability case we must have medical records to prove that your condition makes you disabled.  If you don’t go to the doctor or take your medication as prescribed it will be very difficult to win your case.
We know that you are probably saying that you don’t have any medical insurance and that you cannot afford to go to the doctor or to buy your prescription drugs.  I have had numerous clients testify to this at a hearing, but when asked will admit to buying, at least, two packs of cigarettes a day or some other expense the judge will conclude unnecessary.
The David Throesch Law Firm will provide you will a list of free or low cost medications and pharmacies. We are not necessarily recommending any of these but you need to obtain medical care and your prescriptions somewhere.  If you are still not able to obtain the medical care and/or prescriptions, you should be ready to testify as to what unsuccessful effort you have made to do so and that you have not spent your money on some other unnecessary expense.
When you go to the doctor, do not tell them that you are trying to get Social Security Disability or that your lawyer send you there.  Many doctors will put such statements in your medical records, and it will look like the only reason you are going to the doctor is an attempt to get disability benefits.  You should be very factual when telling the doctor what is wrong with you.  Do not exaggerate your condition; while at the same time, be sure to tell them everything that is wrong with you.  You should also be aware that some doctors will watch you get out of your car and enter their office, or watch you leave their office, to see if you are having the problems as you described to them.  They will also put in your records anything you tell them concerning drug and/or alcohol abuse or if you are working.
If you are given any type of tests while at the doctor’s office, give your best effort.  If you do not, your lack of effort will be put in your medical records and that will make it more difficult to win your case.
You should inform us of any doctors or hospitals you go to so we can obtain the medical records for your case.
